As improvements in neuroscience have enabled a better understanding of disorders of consciousness as well as methods to treat them, a hurdle that has become all too prevalent is the denial of coverage for treatment and rehabilitation services. In 2011, a settlement emerged from a Vermont District Court case, Jimmo v. Sebelius, which was brought to stop the use of an “improvement standard” that required tangible progress over an identifiable period of time for Medicare coverage of services. While the use (...) of this standard can have deleterious effects on those with many chronic conditions, it is especially burdensome for those in the minimally conscious state, where improvements are unpredictable and often not manifested through repeatable overt behaviors. Though the focus of this paper is on the challenges of brain injury and the minimally conscious state, which an estimated 100,000 to 200,000 individuals suffer from in the United States, the post-Jimmo arguments presented can and should have a broad impact as envisioned by the plaintiffs who brought the case on behalf of multiple advocacy groups representing patients with a range of chronic care conditions. In recent years a number of books have been published that offer short autobiographical essays of academics, focusing on their research and how their life history affected their scholarly development. These could be labeled as "intellectual journey narratives." Some volumes focus on philosophers and their religious faith or lack thereof (e.g., Clark, 1997, Antony, 2007). Psychology has its own version of the intellectual journey narrative, in T. S. Krawiec's (1972, 1974, 1978) multivolume set of autobiographical essays by contemporary psychologists. Discussion of the ethics of memory modification technologies has often focused on questions about the limits of their permissibility. In the current paper, I focus primarily on a different issue: when is it rational to prefer MMTs to alternative interventions? My conclusion is that these conditions are rare. The reason stems from considerations of autonomy. When compared with other interventions, MMTs do a particularly poor job at promoting the autonomy of their users. If this conclusion is true, moreover, it provides (...) a fresh perspective on debates about the permissibility of MMTs. On the one hand, for those who would limit the use of MMTs to a narrow range of circumstances, the conclusion that MMTs are rarely preferable gives them further reason to eye MMTs with suspicion. On the other hand, for those who view MMTs as permissible in a wide range of circumstances, the conclusion may deflate their endorsement. (shrink)

Abstract:In this essay, I explore the recent cultural and epistemological turns in sociological music education research. Changes in the economy—and most specifically in the modes of production aided by changes in technology—provide a frame for understanding the cultural and epistemological turns within music education research in sociology. The economy has gone through a process of “dematerialization,” privileging non-material aspects—like mental conceptions of the world, symbols, culture, and social processes—over material considerations. Similarly, sociological research in music education, in its epistemological and (...) cultural turns, has gone through a process of dematerialization where symbols, culture, and mental conceptions have become the frames and emphases within music education. This is influenced by “the postmodern condition” where ideas and “culture” have become seats of power. After a brief introduction, I review dialectics, moving to the subcategory dialectical materialism which has come to signify Marx’s contribution to dialectics. Next, I apply dialectical materialism to the cultural and epistemological turns in sociological music education research, tracing changes in the economy and their influence over emphases in sociological research in music education. According to Macklin & Natanson (2019), one reason unusual practices can be misidentified as usual care is that “instead of using pertinent, accurate information describing usual care, investigators may rely on the opinion of ‘experts’ in the field, whose information may be out of date or otherwise inaccurate." We find Macklin & Natanson’s insights about misattributed expertise crucial, and suggest their discussion can be elucidated further by characterizing it in the context of Ballantyne (2018)’s recent exploration of what he calls (...) epistemic trespassing. What insights can be drawn from this characterization? In this commentary, we highlight two. First, the characterization elucidates the serious consequences that can result from epistemic trespassing. Second, the characterization of Macklin & Natanson’s cases as instances of epistemic trespassing offers us a potential roadmap for overcoming some of the problems the authors identify. (shrink)

This essay offers a standard by which to assess the feasibility of market anarchism. In anarchist thought, the concept of feasibility concerns both the ability and the willingness of private defense agencies to liberate their clients from state oppression. I argue that the emergence of a single stateless pocket of effective, privately-provided defense for a “reasonable” length of time is sufficient to affirm feasibility. I then consider the failure of private defense agencies to achieve even this standard. Furthermore, I identify (...) five possible explanations for the conspicuous absence of private defense agencies. These explanations are entrepreneurial, technological, or economic in nature, or result from a lack of consumer demand or a lack of incentive for violence specialists to refrain from aggression. Of these, only an economic deficiency renders anarchism intrinsically unworkable. (shrink)

We suggest that consciousness (C) should be addressed as a multilevel concept. We can provisionally identify at least three, rather than two, levels: Gray's system should relate at least to the lowest of these three levels. Although it is unlikely to be possible to develop a behavioural test for C, it is possible to speculate as to the evolutionary advantages offered by C and how C evolved through succeeding levels. Minimum deterrence, though consistent with the nonaggression principle, is inadequate to deter states from invading anarchist territory and provides inadequate means of territorial defense when deterrence fails. In order to be effective, and thus attract clients, private defense agencies may want to adopt a military posture that incorporates first-strike counterforce and second-strike countervalue capabilities. To this end, they must acquire weapons of mass destruction—including tactical and strategic nuclear weapons—and long-range delivery vehicles capable of penetrating deep into enemy territory. They must (...) also decline to extend the nonaggression principle to states and individuals outside the voluntary defense network. Paradoxically, advertising such a posture while possessing a nuclear arsenal will save lives on both sides by minimizing the probability that anarchists must ever wage a defensive war at all. Participation in competition festivals—where students and ensembles compete against each other for high scores and accolades—is a widespread practice in North American formal music education. In this article, I use Marx's theories of labor, value, and phantasmagoria to suggest a capitalist logic that structures these competitions. Marx's theories might suggest that one of musical performance's educational use-values is its function as a representation of the labor of musical learning. Competitions reward the hiding of this use-value by privileging performances that conceal (...) the labor of musical learning. In hiding this use-value, the performance's exchange-value, or "price," is increased by gaining a higher score. In this way, competitions are phantasmagoric: they conceal learning within the performance in thrall of the exchange-value of a high score. Despite these flaws in competitions, educators and students might exploit competition festivals' value of coming together and comparing learning with others. Rather than retreating from competition festivals, educators might transform them by imagining renewed practices where students and educators come together to share their learning through performance, listening, and dialogue. Molecular genetic data have greatly improved our ability to test hypotheses about human evolution. During the past decade, a large amount of nuclear and mitochondrial data have been collected from diverse human populations. Taken together, these data indicate that modern humans are a relatively young species. African populations show the largest amount of genetic diversity, and they are the most genetically divergent population. Modern human populations expanded in size first on the African continent. These findings support a recent African origin (...) of modern humans, but this conclusion should be tempered by the possible effects of factors such as gene flow, population size differences, and natural selection. Nutt (Ave Maria, FL: Sapientia Press, 2021), ix + 422 pp.This volume is a collection of papers presented at the "Thomas Aquinas and the Crisis of Christology" conference (...) at the Aquinas Center of Ave Maria University in Ave Maria, Florida, in February 2020. Dozens of papers were presented at the conference; this volume contains many of the plenary papers and the two keynote addresses given by Bruce Marshall and Thomas Joseph White, O.P.The title, especially the term "crisis," has multiple meanings in the essays. On the one hand, some of them address the crisis in contemporary Christology. For example, Michael Dauphinais draws on Aquinas's theology of participation to pose what he sees as a better alternative to Richard Rohr's The Universal Christ. As Dauphinais shows, Rohr's popular Christology conflates Incarnation and creation as one and the same reality. Through careful exegesis of Aquinas's Commentary on John, Dauphinais argues that the Incarnation must be distinct as a unique act of God, and thus decidedly not the same as creation (253). On the other hand, as J. Augustine DiNoia observes in his foreword, the term "crisis" comes from the Greek krisis, or "judgment" (ix). Christ's judgment of all human beings emerges as a persistent theme in the volume. So Andrew Hofer's introduction explores Aquinas's teaching on Christ's judgment of teachers of the faith, noting the implications for theologians who hold the office of teacher. Marshall's and Daria Spezzano's essays are powerful accounts of Christ's role as judge. Both diagnose contemporary crises of faith over which we will be judged and remind us that the Lord Jesus judges to save those who love him. These essays read almost like sermons, and they deserve careful attention when [End Page 1435] Christ's judgment seems irrelevant in an age when God can only be thought to be winsome and nice.Some of the essays contribute to ongoing Thomistic scholarly debates. The vexed question of how to understand the esse secundarium in article 4 of Aquinas's De unione verbi incarnati receives two essays: one by Roger Nutt and the other by Steven A. Long. Nutt argues that Aquinas did not reverse his teaching on the single esse of Christ in the De unione. He observes that Aquinas uses the terms principale and secundarium to manifest "the ultimate unity of composite realities," and thus secundarium esse is not "second esse" in the order of being (87). Like Nutt, Long argues that Aquinas is consistent in his position on Christ's singular esse. He invokes a wide array of interpretive and metaphysical arguments in a mere nine pages. Though they do not resolve the problem (at least in my view: how could an esse distinct from another esse be numerically the same esse, as they would have to be for Christ to have one esse?), they are useful contributions to the ongoing interpretation of Aquinas on this point.Similarly, Christ's human knowledge in Aquinas's theology and Catholic doctrine gets two essays. White expands on prior work on this topic and argues that Christ maintained consciousness of his filial identity prior to the resurrection. As usual, he does careful work deploying the insights of Catholic doctrine in conversation with biblical studies. Simon Francis Gaine expands on his argument in Did the Saviour See the Father? Christ, Salvation and the Vision of God by arguing that a divine person does not need to have the beatific vision to be incarnate. He contrasts metaphysical necessity with soteriological necessity; Christ needed to have the beatific vision to give it to us, but he did not need it as a necessary consequence of being incarnate. It would be interesting to see Gaine and other Thomists interact with John Duns Scotus's argument that Christ could be incarnate without the beatific vision, or highest possible grace (Ordinatio III, d. 13). Prolonged survival after the declaration of death by neurologic criteria creates ambiguity regarding the validity of this methodology. This ambiguity has perpetuated the debate among secular and nondissenting Catholic authors who question whether the neurologic standards are sufficient for the declaration of death of organ donors. Cardiopulmonary criteria are being increasingly used for organ donors who do not meet brain death standards. However, cardiopulmonary criteria are plagued by conflict of interest issues, arbitrary standards for candidacy, and the lack of standardized (...) protocols for organ procurement. Combining the neurological and cardiopulmonary standards into a single protocol would mitigate the weaknesses of both and provide greater biologic and moral certainty that a donor of unpaired vital organs is indeed dead. In 1903 the Cody Road opened, leading travelers from Cody, Wyoming, to Yellowstone National Park. Cheyenne photographer J. E. Stimson traveled the route during its first week in existence, documenting the road for the state of Wyoming's contribution to the 1904 World's Fair. His images of now-famous landmarks like Cedar Mountain, the Shoshone River, the Holy City, Chimney Rock, Sylvan Pass, and Sylvan Lake are some of the earliest existing photographs of the route. In 2008, 105 years later, Michael (...) Amundson traveled the same road, carefully duplicating Stimson's iconic original photographs. In Passage to Wonderland, these images are paired side by side and accompanied by a detailed explanation of the land and history depicted. Amundson examines the physical changes along "the most scenic fifty miles in America" and explores the cultural and natural history behind them. This careful analysis of the paired images make Passage to Wonderland more than a "then and now" photography book--it is a unique exploration of the interconnectedness between the Old West and the New West. It will be a wonderful companion for those touring the Cody Road as well as those armchair tourists who can follow the road on Google Earth using the provided GPS coordinates. The American Constitution held out the hope that ordinary people were capable of deciding their own fates, and in doing so it immeasurably elevated the dignity of common people. The organization and interplay of the parts that comprise the whole American government exist to provide people the opportunity to govern themselves and, at the same time, reveal the limits of democratic self-rule. The forgetting of these limits is not only destructive to the constitution but the nation as a whole.

This volume brings together much of the most influential work undertaken in the field of virtue ethics over the last four decades. The ethics of virtue predominated in the ancient world, and recent moral philosophy has seen a revival of interest in virtue ethics as a rival to Kantian and utilitarian approaches to morality. Researchers from across the social sciences have found consistent deviations from the predictions of the canonical model of self-interest in hundreds of experiments from around the world. This research, however, cannot determine whether the uniformity results from universal patterns of human behavior or from the limited cultural variation available among the university students used in virtually all prior experimental work. To address this, we undertook a cross-cultural study of behavior in ultimatum, public goods, and dictator games in a range of (...) small-scale societies exhibiting a wide variety of economic and cultural conditions. We found, first, that the canonical model – based on self-interest – fails in all of the societies studied. Second, our data reveal substantially more behavioral variability across social groups than has been found in previous research. Third, group-level differences in economic organization and the structure of social interactions explain a substantial portion of the behavioral variation across societies: the higher the degree of market integration and the higher the payoffs to cooperation in everyday life, the greater the level of prosociality expressed in experimental games. Fourth, the available individual-level economic and demographic variables do not consistently explain game behavior, either within or across groups. Fifth, in many cases experimental play appears to reflect the common interactional patterns of everyday life. The idea that payment for research participation can be coercive appears widespread among research ethics committee members, researchers, and regulatory bodies. Yet analysis of the concept of coercion by philosophers and bioethicists has mostly concluded that payment does not coerce, because coercion necessarily involves threats, not offers. In this article we aim to resolve this disagreement by distinguishing between two distinct but overlapping concepts of coercion. Consent-undermining coercion marks out certain actions as impermissible and certain agreements as unenforceable. By contrast, (...) coercion as subjection indicates a way in which someone’s interests can be partially set back in virtue of being subject to another’s foreign will. While offers of payment do not normally constitute consent-undermining coercion, they do sometimes constitute coercion as subjection. We offer an analysis of coercion as subjection and propose three possible practical responses to worries about the coerciveness of payment. (shrink)

Finding that an avian herpesvirus can cause atherosclerosis in chickens prompted studies of human herpesviruses in human atherosclerosis. Antigens and nucleic acid sequences of cytomegalovirus (CMV), a widespread member of the herpesvirus family, were found in arterial lesions in human atherosclerosis, but infectious virus has not been observed. In atherosclerosis patients, high levels of CMV antibodies are present, suggesting the presence of virus that had been activated from a latent state. Atherosclerosis also develops in immunesuppressed heart transplant patients infected with (...) CMV. The properties of CMV are consistent with its involvement at several levels of the atherogenic process. If this concept is correct, immunization with a CMV vaccine should prevent CMV infection and atherosclerosis. (shrink)
